Comparative Civil Procedure

Requirements and General Information

In this course we will discuss approaches taken in different jurisdictions towards key problems of civil litigation. In particular, we will look at the following topics:

  • Court organization
  • Costs and funding of civil litigation
  • Amicable settlement within and outside of ordinary proceedings
  • Jurisdiction
  • Collective redress
  • Insolvency proceedings
  • Evidence
  • Appeals
  • Arbitration and the courts
  • COVID-19 and civil procedure

Ideally, students should already have taken an introductory course on civil procedure in their home jurisdiction. We recommend that students who have no previous knowledge of civil procedure study at least an introductory textbook from their own jurisdiction.

Since this is a workshop-style course, class attendance and participation in the discussions is mandatory and will count towards your grade. In addition, students are expected to give a presentation on one of the topics of the course. Finally, there will be an oral exam at the end of the course.
